The only condition is that he be permitted to telecommute, and recieve the written apology as stated by the law office retained by Albian Sands Energy. We have been provided with the documentation submitted to Albian Sands Energy Inc, and the Alberta Human Rights Commission. From what our interns told us, this proposal protects not only the worker, but saves Albian Sands Energy Inc. additional legal fees and potential for further liability and injury to this person.

We think they have been offered the deal of a lifetime.

This matter involves one of the Occupational Health and Safety Officers employed at the Muskeg River Mine Site, commonly know as Albian Sands Energy Incorporated. Information below is taken from publicly shared sources.

BACKGROUND - ALBIAN SANDS ENERGY

Albian Sands Energy Inc. operates the Muskeg River Mine. The Muskeg River Mine and the Scotford Upgrader together comprise the Athabasca Oil Sands Project - a joint venture of Shell Canada Limited, Chevron Canada Limited (a wholly owned subsidiary of ChevronTexaco Corp.) and Western Oil Sands Inc. The amount of oil and oil related products produced by the Athabasca Oil Sand Project could fill one in three cars in Alberta. It will supply 10 percent of Canada's oil needs.

The Muskeg River Mine stands on Shell Canada Limited's Lease 13. The combined resource of the Muskeg River Mine and Lease 13 contains more than five billion barrels of mineable bitumen. This is about equal to twice the amount of conventional oil reserves remaining in Alberta. The oil sands deposit is close to the surface and contains a high concentration of oil, making it ideally suited to mining. The Muskeg River Mine will recover 1.65 billion barrels of bitumen over 30 years.

Albian Sands Energy Inc. garnered its name from the Albian Boreal Sea which molded the landscape we have come to know as Northern Alberta. Over 100 million years ago, as the Albian Sea moved over the McMurray sands, a blanket of marine shale was deposited on its floor and trapped the hydrocarbons of the McMurray Formation. The resource of the Muskeg River Mine is a legacy of the Albian Sea. We thought it fitting that the company that brings these ancient sands to the light of day should bear this name.

Now with this being said, is it not a sad day when such great ideas are buried in the sake of profits. What is pain and suffering worth to the person in the photo's below? This has affected exposed areas, hands and face. (Face not shown to protect the person involved)

We can now see the clear link between the times these photographs were taken and the individual's employment, and in residing in the regional municipality of Wood Buffalo. Now that these images have been made public what valid reasoning would Albian Sands Energy and Shell Canada have for denying any authorization to test for substances which we feel is the cause of this and many other illnesses within the region?

We are asking you, the general public and concerned citizens to contact the individuals on the sidebar to point this fact out. What are they hiding? Why are they refusing to grant authorization for independent laboratory analysis if they had nothing to fear? Clearly it has been demonstrated that to leave the region and the workplace has been beneficial to the recovery of this individual.

Not only has this individual been forced to endure physical pain and suffering of this exposure, but has also been subjected to severe economic hardship due to the actions of the employer and disability insurance carrier.

At this time his bills and accumulated costs have soared in excess of $20,000 while these corporations report record earnings

At this time we are aware of 68 people at four local oilsands sites that have the same outbreaks. Many that have been forced to leave positions prior to obtaining proper insurance or compensation.

Interview with the HSE Coordinator Involved at Albian Sands Energy Inc. August 5th 2007

• Question - what do you think is the cause of this condition?

• Answer - It could be from a variety of different sources singularly or combined from a change in process water, temperature, ambient conditions or plant upset. Without proper third-party analysis of samples collected it is clearly unlikely we will be able to obtain data which would identify agents and or toxins which are dispersed into the atmosphere by cooling tower vapours. These vapours as you know are water. They will eventually land on plants, animals and people prior to making their way back into the Athabasca River and groundwater tables.

• Question - have there been other individuals with similar outbreaks?

• Answer - during the spring 2006 turnaround a number of individuals employed by Eveready Industrial Services while on contract with Albian Sands Energy Inc. contracted severe rashes to the hands, face and neck areas. During this time I first noticed a similar rash on my neck to which I attributed to plain old windburn from being outdoors. I did spend some time providing HSE coverage in the extraction area at Albian Sands Energy Inc. where these contract employees came to contact with this unknown agent. Most of the individuals involved with coming into contact with this unknown toxin/substance, or agent were involved in the cleaning of tanks with high-pressure hoses. A number of other individuals working at other oilsands sites have been subjected to similar outbreaks. As of this time there are roughly 68 others with similar conditions living and working in and around the Fort McMurray area, and the regional municipality of Wood Buffalo.

• Question - so you are saying that the contamination is caused and spread through water?

• Answer - without being able to adequately test samples collected by an independent laboratory it cannot be said with absolute certainty. The fact that Albian Sands Energy Inc. refuses to grant authorization for testing would suggest this to be the case. If they are aware or even if they are unaware they should be fully cooperating in the investigation and preventing similar outbreaks and or unintentional dumping of toxins into the atmosphere and water system.

• Question - what were you told this could be?

• Answer - I was told by one of the occupational health nurses employed by Albian Sands Energy Inc. that in her professional opinion the outbreak to my hands and face was the result of the HIV infection.

• Question - what did you say and or do when informed of this?

• Answer - I was certainly taken a back by comments such as this coming from such an unqualified RN. I have since filed a complaint with the Alberta Human Rights Commission, and the individual responsible for the comment has since left her position with Albian Sands Energy Inc.

• Question - what impact did this have on you and your family?

• Answer - Clearly it has taken a great toll both emotionally and financially. To put an individual and their loved ones through such unnecessary emotional hardship and duress shows the complete disregard for life that this organization has.

• Question - what has Albian Sands Energy Inc. done to rectify the situation?

• Answer - After over a year of waiting we still have no answers or resolution. This company has done nothing but sidetrack the issues and attempt to make themselves look like they are doing all they are capable of to come to a resolution. Yet every proposal submitted by legal counsel has been countered. The only thing they have done to date is to offer via e-mail an apology for “comments made”. They have done nothing to reimburse or compensate for the allegations and injuries endured by myself and my family.

• Question - what will be your next course of action?

• Answer - well this is what we are doing now. Since these corporations are able to buy off, buy out or otherwise circumvent the chosen venues. We now are at the point where public attention to the issue is required. We need to bring pressure to this and other companies to release access to independent consultants the unrestricted access needed to collect samples. Failing to do so continues to make them seem as if they are hiding the truth from the public.

The Albian Sands statement "Everyone Home Safley Always" is far from the truth.

We hope that with the support of the general public the proper and appropriate pressures can be applied to make not only this corporation but others become fully compliant. We need to have these corporations publicly known for the inhumane acts they commit all of the sake of corporate greed. We need the public to know that everything is not black and white, and that these companies will do anything to protect profits.
